Regulations of the classical guitar competition MARTINEZ

1. GENERAL PROVISIONS
1.1 As part of the Summer Guitar Festival 2024, it is planned to conduct the MARTINEZ classical guitar competition (hereinafter referred to as ‘Competition’) in two age categories, consisting of an audition of participants by a Jury on 16 July 2024.
1.2 The Competition is organised on the terms and conditions set out in these Regulations (hereinafter referred to as ‘Regulations’) and in accordance with generally applicable provisions of law.
1.3 The organiser of the competition is the Culture and Art Center of Wrocław (Ośrodek Kultury i Sztuki – OKiS) – Cultural Institution of the Local Government of the Lower Silesian Voivodeship with its seat in Wrocław, Rynek-Ratusz 24, 50-101 Wrocław (hereinafter referred to as ‘Organiser’).
1.4 1.4 The Competition is not a game of chance within the meaning of the Gambling Act of 19 November 2009.
1.5 The Competition Regulations are available at www.guitarfestival.okis.pl.
1.6 The Competition is organized by the Organizer in the area of the palace complex in Krzyżowa (Krzyżowa 7, 58-112 Grodziszcze), on 16 July 2024 (this day includes the conduct of the Competition, the settlement and the post-Competition period).
1.7 The Competition is conducted live, with audience participation and in the presence of the Jury.
1.8 The Organiser informs that the Competition is in no way or to any extent sponsored, endorsed, carried out, administered or associated with Facebook available on the Internet at URL: http://www.facebook.com/ (hereinafter referred to as ‘Facebook’).
2. OBJECTIVES OF THE COMPETITION
2.1 The subject matter of the Competition is to perform a competition task, i.e. a solo guitar
performance of between 10 and 12 minutes in length in front of a Jury.
2.2 The Competition is open to classical guitarists in one of the age categories – up to the age of 18 and over 18.
2.3 The aim of the Competition is to present and promote young talents – guitarists participating in the Summer Guitar Festival 2024, to familiarise young musicians with public presentation on stage and to interact with festival participants.
COMPETITION RULES
3.1 The Competition is a one-stage, open competition, aimed at people who are attending the Summer Guitar Festival 2024 workshops on the basis of the paid MAESTRO PACKAGE fee.
3.2 The Competition is held in two age categories: for participants up to the age of 18 and for participants over 18 years of age.
3.3 The languages of the Competition are Polish and German.
3.4 Participation in the Competition is voluntary. A person entering the Competition in accordance with the provisions of these Regulations becomes a participant (hereinafter referred to as ‘Participant’) and thereby accepts all provisions of the Regulations. By paying the MAESTRO PACKAGE fee for participation in the Summer Guitar Festival 2024, the participant confirms that he/she:
a) accepts the terms and conditions of the Competition Regulations;
b) consents to the publication of his/her name and surname, as well as his/her image, when the results of the Competition are announced, as the Winner of the Competition.
3.5 Participation in the Competition is subject to payment of the MAESTRO package fee for participation in the Summer Guitar Festival 2024.
3.6 The Participant is not obliged to participate in the competition and may withdraw at any time. 3.7 The winners will be selected by a Jury made up of the Organisers and Lecturers (guitar teachers) with the appropriate knowledge to assess the students' skills. The Jury will take into account, among other things, musical appreciation, creativity, choice of repertoire and the technical aspect of performance when assessing the competition performances.

3.8 The results of the Competition will be announced on 20 July 2024, during the final concert and the concert of the winners, and on the following websites: www.guitarfestival.okis.pl, www.okis.pl and on the OKiS Fanpages.
3.9 The Organiser reserves the right to moderate the content of the Fanpage made available as part of the Competition (competition photos, answers, descriptions, comments) added by the Participants if, in the Organiser's opinion, they may be against the law, the Regulations, Facebook.com regulations, principles of good conduct, may offend the feelings or violate the rights of others, may contain pornographic or drastic content, or violate the interest and good name of OBC, or are unrelated to the Competition. Participants are prohibited from posting links or references or URLs to other websites.
3.10 The Organiser stipulates that the performances submitted to the Competition may not infringe the law, in particular copyrights and personal rights of third parties. Participants in the Competition take full responsibility in the event of any claims being made by third parties for infringement of their rights as a result of the Organiser's use of the works in accordance with these Regulations, and take full responsibility for the content they post on the Fanpage.
3.11. In matters not provided for in the Regulations, the Organiser has the casting vote.
4. AWARDS
4.1. From among all Participants, the Jury will select the winners, who will be awarded with in-kind prizes sponsored by a sponsor – Interton Classic and the Organisers.
4.2. The person to whom the prize indicated in clause 4.1. shall hereinafter be referred to as ‘Winner’.
4.3. Winners shall be notified of how, when and where to collect their prize by 20 July 2024 (the day of the prize-giving ceremony).
4.4 Once the Winners of the Competition have been selected, the Jury meeting for the determination of this Competition will be concluded (minutes of the meeting shall be taken). Immediately after the selection of the Winners by the Jury, Participants shall be informed of the results of the Competition based on the Jury's verdict. Notification shall be made verbally and by the Organiser adding a comment about being a winner on the SGF Fanpage. The prize shall be collected upon completion of the prize collection protocol on site.
4.5 The provision of false or incomplete data (name, surname and telephone number) shall constitute grounds for refusal of the prize to the Winner.
4.6 The Organiser reserves the right to award only one prize in each age category, at the Organiser's discretion.
4.7 The prize Winner may refuse to accept the prize awarded to him/her.
4.8 There is no cash equivalent for prizes won. The Winner may not request to exchange the prize won for another prize.
4.9 The Organiser's liability for any factual or legal impediment preventing the collection or realisation of the prizes referred to in clause 4.1. above, shall be excluded unless fault can be attributed to it in accordance with Article 415 of the Civil Code.
5. COPYRIGHTS
5.1 By entering the Competition and accepting the Regulations, the Participant declares that he/she holds all moral and economic rights to the Competition Work and that the Competition Work does not in any way violate the provisions of the law in force or any rights or personal rights of third parties. The Participant additionally agrees that the Competition Organiser may use the published photo for the purposes necessary to conduct the competition and select the winners.
6. PERSONAL DATA 6.1 By entering a given Competition, the Participant agrees that the Organiser may process
his/her personal data for the purpose of conducting the Competition and selecting the Winners.
6.2 The Organiser informs that the personal data provided will only be processed for the purpose of conducting the Competition. The Controller of the personal data set is the Organiser. The Organiser informs the Participant that he/she has the right at any time to inspect his/her data, to correct it and to request its erasure.

6.4 Personal data of the Participants of the Competition shall be processed exclusively for the purpose of conducting the Competition and, in the case of the winner, also for the purpose of issuing the prize.
6.5 The Participant has the right of access to the content of the data and the right to rectify, erase or restrict processing, as well as the right to object, request the cessation of processing and data portability, the right to withdraw consent at any time and the right to lodge a complaint with the supervisory authority (i.e.: President of the Personal Data Protection Office, ul. Stawki 2, 00-193 Warsaw).
6.6 The provision of data is voluntary but necessary for the performance of the terms and conditions of this contract. If data is not provided, it will not be possible to conclude this contract.
6.7 The data provided by the Participants will not be shared with third parties. Only institutions authorised by law will be recipients of the data.
6.8 The data provided by Participants will not be subject to profiling.
6.9 The Data Controller has no intention to transfer personal data to a third country or international organisation.
6.10 Personal data will be kept for the time required for their use.
6.11 In view of the above, I consent to the processing of my personal data in accordance with the above purpose.

7. FINAL PROVISIONS
7.1 The Competition may be cancelled if:
a) nobody enters the Competition,
b) for other important reasons concerning the Organiser.
7.2 The decision to cancel the Competition will be communicated to Participants on 16 July 2024 live and via the Fanpage.
7.3 Participants hereby waive all claims against the Organiser relating to the cancellation of the Competition.
7.4 A Participant may lodge a protest with the Organiser against the Organiser's actions taken in the course of the Competition (including its non-action). A protest shall be lodged in writing to the Organiser within 3 working days from the date of the action (in the case of non-action – the deadline by which the Organiser should have carried it out) or the date on which the Participant became aware of the grounds for lodging a protest, however, in no case later than the date of the settlement of the Competition. The Organiser will consider the objection within 3 days of its submission. The Organiser shall inform the other Participants of the lodging of the protest, its content and allegations, as well as the resolution of the protest, via email or Fanpage.
7.5 The Participant undertakes to indefinitely keep all information obtained in connection with the Competition confidential.
7.6 All potential disputes related to the organisation, course and settlement of the Competitions, including those concerning prizes, shall be considered and settled by the competent common court of law in Wrocław.
7.7 In matters not covered by these Regulations, the provisions of the Civil Code shall apply.
7.8 These Regulations are the only document setting out the rules of the Competition.
7.9 The Organiser reserves the right to interpret the provisions of these Regulations. All decisions of the Organiser shall be binding and final.
7.10 The Organiser reserves that it shall not be liable for events preventing the proper conduct of the Competition which it was unable to foresee or prevent, in particular in the event of fortuitous events, including force majeure.
7.11 The Organiser reserves the right to amend these Regulations at any time, including the right to change the prizes.
