Regulations of the „SUMMER GUITAR FESTIVAL 2021” competitions

1.GENERAL PROVISIONS

1.1 Two competitions involving the auditions of the participants of the Summer Guitar Festival 2021 by the JURY on:
– 29 July 2021, hereinafter referred to as the „Martinez Competition”.
– 28 July 2021, hereinafter referred to as the „Takamine Competition”

Competitions are organized in accordance with the rules set out in these regulations (hereinafter: „Regulations”) and in accordance with generally applicable law.

1.2 The organizer of the competitions is the Culture and Art Center in Wrocław, the Cultural Institution of the Lower Silesian Self-Government with its seat in Wrocław, Rynek-Ratusz 24, 50-101 Wrocław (hereinafter: the „Organizer”). Competitions are organized and broadcast (announced) by the mass media (Internet).

1.3 The competitions are not a game of chance within the meaning of the Gambling Act of 19 November 2009.

1.4 The Competition Regulations are available on the website: www.guitarfestival.okis.pl
a) Competitions are organized by the Organizer in the area of ​​the palace complex in Krzyżowa (Krzyżowa 7, 58-112 Grodziszcze), on May 17 to August 2, 2021 (this period includes the announcement of the Competitions, the conduct of the Competitions, their settlement and the post-competition period).
b) The competitions are conducted live, in the presence of the JURY.
c) The Organizer informs that the Contests are in no way or in any way sponsored, supported, conducted, administered or associated with the Facebook website available on the Internet computer network at the URL: http://www.facebook.com/ (hereinafter: „Facebook”).

2. ASSUMPTIONS OF THE COMPETITIONS

2.1 The subject of the „Takamine Competition” is the performance of the competition task, ie a solo guitar performance between 7 and 10 minutes before the competition JURY.
2.2. Acoustic guitarists (fingerstyle) can take part in the „Takamine Competition”.
2.3. The subject of the „Martinez Competition” is the performance of the competition task, ie a solo guitar performance 10 to 12 minutes long before the competition JURY. 2.4. Classical guitarists can take part in the „Martinez Competition”.
2.5. The aim of these Competitions is to activate people interested in guitar workshops, to popularize the Summer Guitar Festival workshops and the image of the Culture and Art Center in Wrocław.

3.RULES OF CONDUCTING COMPETITIONS

3.1 Both competitions are single-stage, open, addressed to people who take part in the Summer Guitar Festival workshops on the basis of the paid MAESTRO STANDARD or WEEKEND PACKAGE.
3.2 The languages ​​of the Competitions are Polish and English.
3.3 Participation in the Competition is voluntary. A person joining the Contests in accordance with the provisions of these Regulations, he becomes its participant (hereinafter the „Participant”) and thus accepts all provisions of the Regulations. By paying the fee for the MAESTRO STANDARD PACKAGE or the WEEKEND PACKAGE, the participant confirms that: a) accepts the terms of the Competition Regulations; b) agrees to the publication of his name and surname as well as his image as the Competition Winner when announcing the Competition results.
3.4 Participants may only be adults who are 18 years of age at the latest on the date of the commencement of a given Competition.
3.5 The condition for participation in a given Competition is: a) Participation in the Summer Guitar Festival workshops is possible ONLY by paying the fee for the MAESTRO STANDARD package or the WEEKEND package by the closing date of the recruitment for the workshop.
3.6 The Participant is not obliged to participate in the Contests and may resign from participation in the Contests at any time.
3.7 The winners will be selected by a jury composed of the Organizers and Lecturers (guitar teachers) who have the appropriate knowledge to assess the students’ skills. During the evaluation of the competition entries, the jury will take into account, musical education, creativity, selection of repertoire and technical aspect of performance.
3.8 The results of the Competitions will be announced on 30 July 2021, during the workshops and on the website www.guitarfestival.okis.pl and www.okis.pl and on the OKIS Fanpages.
3.9 The Organizer reserves the right to moderate the content on the Fanpage made available as part of the Competition (competition photos, answers, descriptions, comments) added by the Participants, if in the Organizer’s opinion they may be contrary to the law, Regulations, Facebook.com regulations, decency , offend feelings or infringe the rights of others, contain pornographic or drastic content, violating the interest and good name of OBC, or not related to the Competition. Participants are forbidden to post links or references or URLs to other websites.

3.10 The Organizer reserves that the works submitted to the Competition may not violate the law, in particular copyrights and personal rights of third parties. Competition participants are fully liable in the event of any claims by third parties for violation of their rights as a result of the Organizer’s use of works in accordance with these Regulations and shall be fully responsible for the content posted by them on the Fanpage. In matters not provided for in the Regulations, the decisive vote belongs to the Organizer.

4. PRIZES

4.1. The jury will select winners from among all Participants, who will be awarded in-kind prizes.
4.2. The person who was awarded the prize indicated in point 4.1. will be hereinafter referred to as the „Laureate”.
4.3. The winners will be informed about the method, date and place of collecting the prize by July 30, 2021 (award day).
4.4. Upon the selection of the Competition Winners, the jury meeting concerning the settlement of these Competitions is completed (a protocol will be drawn up from the meeting). Immediately after the selection of the Laureates by the jury, the Participants will be informed about the results of the Competitions on the basis of the JURY verdict. The notification will be made in words and by adding a comment by the Organizer about being a laureate on the SGF Fanpage. The prize will be collected after filling in the prize claim protocol on the spot.
4.5. Providing false or incomplete data (name, surname and telephone number) will be the reason for the refusal to hand over the prize to the Winner.
4.6. The Organizer reserves the right to award only one prize, depending on the Organizer’s choice.
4.7. The prize winner may refuse to collect the prize awarded to him.
4.8. There is no cash equivalent for the prizes won. The winner may not request the exchange of the won prize for another prize.
4.9. The Organizer’s liability for any factual or legal obstacles preventing the collection or realization of the awards referred to in point 4.1. above, is excluded, unless it can be attributed to blame in accordance with Art. 415 of the Civil Code.

5. COPYRIGHT

5.1 By joining the Contests and accepting the Regulations, the Participant declares that he is entitled to all personal and property copyrights to the Competition Entry and that the Competition Entry does not in any way infringe the provisions of applicable law or any rights or personal rights of third parties. The participant additionally agrees to the use of the published photo by the Competition Organizer for the purposes necessary to conduct the competition and to select the winners.

6. PERSONAL DATA

6.1 For the proper conduct of the Competitions, the Participant is obliged to provide his personal data (name, surname, telephone number and e-mail address). The transfer of data takes place voluntarily, however, it conditions the possibility of participating in the Competitions and receiving the prize in the event of being a Winner.
6.2 By entering a given Competition, the Participant agrees to the processing of his personal data by the Organizer in order to conduct the Competition and select the Winner.
6.3 The Organizer informs that the personal data provided will be processed only for the purpose of conducting the Competitions. The Organizer is the administrator of the personal data collection. The organizer informs that the Participant has the right to inspect his data, correct them and request their removal at any time.

6.5 Personal data of Competition Participants will be processed only for the purpose of conducting the Competitions, and in the case of the winner – also for the purpose of issuing the prize.
6.6 The participant has the right to access the data and rectify, delete or limit processing, as well as the right to object, request the cessation of processing and transfer of data, the right to withdraw consent at any time and the right to lodge a complaint to the supervisory body (i.e. the President of the Office Personal Data Protection, ul. Stawki 2, 00-193 Warsaw).
6.7 Providing data is voluntary, but necessary to perform the terms of this contract. If the data is not provided, it will not be possible to conclude this contract.
6.8 The data provided by the Participants will not be made available to third parties. Recipients of the data will only be institutions authorized by law.
6.9 The data provided by the Participants will not be profiled.
6.10 The personal data controller does not intend to transfer personal data to a third country or an international organization.
6.11 Personal data will be kept for the time required for their use.
6.12 Bearing in mind the above, I consent to the processing of my personal data in accordance with the above. purpose.

7.FINAL PROVISIONS

7.1 Competitions may be voided if: a) no one will enter the competitions b) for other important reasons concerning the Organizer.
7.2 The decision to cancel the Contests will be announced to the Participants on August 2, 2020 live and via the Fanpage.
7.3 Entrants hereby waive any claims against the Organizer related to the annulment of the Contests.
7.4 In relation to the actions of the Organizer taken in the course of the Contests (including their omissions), the Participant may lodge a protest with the Organizer. The protest should be submitted in writing to the Organizer within 3 working days from the date of the action (in the event of failure – the final date by which the Organizer should perform it) or the day on which the Participant learned about the grounds for lodging the protest, but in no case later than until the Competition is adjudicated. The organizer will consider the objection within 3 days of its submission. The Organizer will inform other Participants about the lodging of the protest, its content and allegations as well as its resolution by mailing or Fanpage.
7.5 The Participant undertakes to keep confidential all information obtained in connection with the Contests for an indefinite period.
7.6 Any possible disputes related to the organization, course and settlement of the Competitions, including those concerning prizes, will be recognized and resolved by the competent common court in Wrocław.
7.7 In matters not covered by these Regulations, the provisions of the Civil Code shall apply.
7.8 These Regulations are the only document defining the rules of the Competitions. 7.9 The Organizer reserves the right to interpret the provisions of these Regulations. All decisions of the Organizer will be binding and final.
7.10 The Organizer reserves that he is not responsible for events that prevent the proper conduct of the Competitions, which he was unable to predict or prevent, in particular in the event of random events, including force majeure.
7.11 The Organizer reserves the right to amend these Regulations at any time of its duration, including the right to change the awards.
